Package Travel Information

Last updated

Why the current offer is not a package under Directive (EU) 2015/2302, how every basket is checked, and what we will not do before a guarantee exists.

Directive (EU) 2015/2302 protects travellers who buy a package: mandatory information before payment, framed termination rights, the organiser's liability for the whole trip, and protection against its insolvency. This page says precisely where otaplan's offer stands in relation to that regime. It does not summarise it in vague terms: the question is whether you benefit from it or not.

What you are buying here today

The directive distinguishes four types of travel service (Article 3(1)): carriage of passengers, accommodation, rental of vehicles, and “any other tourist service” — a category that expressly covers guided tours, excursions and admission to events (recital 18).

otaplan's catalogue currently contains only services in that fourth category: tours, activities and tickets. It sells no transport, no accommodation and no vehicle rental.

Why that is not a package

A package requires the combination of at least two different types of travel service for the same trip (Article 3(2)). Booking several tours, even on the same day and in the same basket, combines only one type: no combination of the current offer can therefore constitute a package, nor a “linked travel arrangement” within the meaning of Article 3(5).

It follows that the pre-contractual information specific to packages, the standard form in Annex I and the insolvency protection of Article 17 do not apply to these sales. You do keep all of your consumer rights: accurate description, all-inclusive price, published cancellation policy, and remedies if the service does not match what was sold. See the terms and conditions and the cancellation policy.

This is not a blanket claim: every basket is checked

The classification does not rest on this page but on the actual content of your basket, examined on every order: which service types are present, the total duration, each service's share of the price, and whether an overnight stay is included. The summary shows the reasoned verdict before you pay.

If a basket did fall under the regime, the information due would be given to you before any payment, standard form included, and a record of that delivery would be kept — pre-contractual information forms an integral part of the contract (Article 6(1)).

Our commitment

Article 17 requires the organiser of a package to guarantee the refund of all payments received, and repatriation where carriage is included. Numenor Group LLC does not hold such a guarantee today, and therefore undertakes not to offer any package for sale until one is in place and published on this page together with the guarantor's identity. Advertising a package without a guarantee would mean selling protection that does not exist.

If that changes

This page will be updated before any package is first offered for sale, and will then carry the ten information headings required by Article 5(1): main characteristics, identity of the organiser and retailer, total price and additional costs, payment arrangements, minimum number of participants, passport, visa and health formalities, right to terminate, insurance, insolvency protection, and the summary of key rights from Annex I.
