The rules of sale: who your contract is with, how booking and payment work, and what happens when plans change.

1. Scope

These terms govern the use of otaplan.com and the booking of the experiences offered on it. They are accepted at the time of payment. The version that applies to a booking is the one in force on that day; a later revision does not change a booking already confirmed.

2. Who your contract is with

Two separate contracts are formed, and the distinction is not a formality:

  • the service contract — the tour, the activity — is between you and the supplier named on the listing. They deliver it, and they answer for it;
  • the intermediation contract — listing, booking, payment collection, voucher, follow-up — is between you and Numenor Group LLC, acting in the name and on behalf of the supplier when collecting the price.

Numenor Group LLC is therefore not the organiser of the activities sold and does not deliver them.

3. Account

A booking can be started without an account, but it is always attached to a valid email address: that is where the confirmation and the voucher are sent. You are responsible for the accuracy of the information you provide and for keeping your credentials confidential.

4. Booking

Choosing a date, a time slot, a language and a number of travellers holds the matching places temporarily: a place is held in the basket for 30 minutes, then released if payment has not completed. A basket is therefore not a booking.

The booking is confirmed once payment is accepted. You then receive a voucher carrying a code: that is what gives you access to the experience, and it must be presented on site.

Some listings ask for traveller details (name, age, health constraints, height for equipment). They are required because the supplier needs them to deliver safely, and an incomplete booking may be refused on site.

5. Prices and currency

Prices are set by the supplier and shown all-inclusive, except for any costs announced on the listing (entrance fees payable on site, options, gratuities — always disclosed before payment).

The site may show a price converted into the currency you selected: that conversion is indicative. The amount actually charged is the one shown on the payment screen, in that screen's currency. Your bank may add its own exchange fees, which the platform does not control.

6. Payment

Payment is made by card through a licensed payment service provider. No card number is stored by the platform: payment details go directly to that provider.

7. Changing or cancelling

The default rule is free cancellation up to 24 hours before the start of the experience, refunded in full. Each listing shows its own rule, and that is the one that applies. The detail — bad weather, cancellation by the supplier, late arrival, no-show, refund times — is in the cancellation policy, which forms part of these terms.

8. No right of withdrawal

What is sold here are leisure activities supplied on a specific date or period. The fourteen-day right of withdrawal therefore does not apply: Article 16(l) of Directive 2011/83/EU, and its national transpositions. The cancellation policy above takes its place — and in the standard case it is more generous than a withdrawal period would be.

9. On the day

The meeting point and time are on the voucher. Arriving late may prevent participation with no refund: a group departure does not wait. The supplier may refuse participation to anyone whose condition or behaviour would compromise the safety of the group; such a refusal does not give rise to a refund. Where an experience requires a minimum number of participants, the listing says so, and a cancellation on that ground is refunded in full.

10. Reviews

Only people who actually booked and attended can post a review of an experience. Reviews are neither bought nor solicited in exchange for anything, and they are not removed for being unfavourable.

11. Liability

The supplier answers for the delivery of the experience, for its conformity with its description and for the safety of its participants. Numenor Group LLC answers for its own service: the accuracy of the listing as it was submitted, the proper working of booking and payment, the issuing of the voucher, and the handling of complaints. Neither party answers for events outside its control (force majeure, administrative decisions, weather making delivery unsafe).

12. Complaints

A complaint goes first to the supplier, through the booking's message thread. If the disagreement persists, the platform can be brought into that same thread and will decide on the evidence: it may grant a full or partial refund, including against the supplier's view. No consumer mediator is appointed at this date; your right to go to court is unaffected.

13. Personal data

See the privacy policy and the cookie policy. In short: the supplier receives what it needs in order to deliver, never your real email address.

14. Governing law and courts

If you are contracting as a consumer, the mandatory consumer protection rules of the country where you live continue to apply to you, and you may bring proceedings in that country's courts. Nothing in these terms can deprive you of that right.

15. Package travel

European package travel rules are covered on a dedicated page, which explains why the current offer does not fall under them.
